Review criteria per LDC Sec. 7.2.2(E)(2)(f) and revise letter of intent to include how merger request meets criteria in letter of intent: • The lots or parcels being merged are legal lots or parcels; • The merger will not adversely affect access, drainage or utility easements or rights-of-way serving the property or other properties in the area; • The merger will not result in a nonconformity not otherwise existing prior to the merger; • The merger is necessary to achieve compliance with the nonconforming lot or record provisions of this Code, or will accomplish a similar purpose; • All separation distances for an OWTS can be met; and • The extraction of areas designated as 100 year floodplain, major drainageways and slopes in excess of 30 percent leaves a single buildable area of at least 30 percent of the lot or parcel's total net area. |
