2. The TIS identifies needed improvements to Hwy 94. Staff anticipates these improvements being a condition of approval of the rezoning request. The applicant will need to coordinate the improvements with CDOT. 10/10/2019 11:35:29 AM

1. If approved, all future development will need to be in compliance with the CS zoning district. Please review the various regulations (uses, dimensional standards) to ensure your proposed development will be compliant.
2. New applications are to be reviewed for compliance with the Water Master Plan. Please add a discussion into the Letter of Intent.

Additional comments and redlines will be uploaded upon completion of the PCD engineering division review.

Regarding modifications to an approved PUD, C.R.S. §24-67-106(1) gives a county the authority to enforce those provisions of a PUD plan related to use. §24-67-106(3)(b) allows a county to modify, remove or release those provisions, provided that
the modification, removal, or release 1) is consistent with the efficient development and preservation of the entire PUD, 2) does not affect in a substantially adverse manner either the enjoyment of land abutting upon or across a street from the PUD or the public interest, and 3) is not granted solely to confer a special benefit upon any person.

Please revise the letter of intent to address these criteria.
