Under 5.2.19 Commercial Mobile Radio Service Facility (CMRS) Facilities, (B) General Standards, (6) Standards for Freestanding CMRS Facilities, (d) Maximum Height for Freestanding CMRS Facilities - "Any tower that exceeds 200 feet shall require FAA approval prior to approval of a special use or variance of use." This statement is not correct. Any object that may penetrate the Part 77 surfaces requires Colorado Springs Airport and Airport Advisory Commission review and may require an FAA airspace analysis. Recommend the following:

"Any tower within the Commercial Airport Overlay District shall be in compliance with CFR 14 Part 77 as reviewed and approved by the Director of Aviation"

Definition: Small Cell - May want to consider additional language on new structures. We've had several requests that wanted to remove the City street lights and replace it with their own light to house the equipment. What if they want to install a new facility that is not located within an existing street light, flag pole, etc.?

Consider establishing a minimum financial assurance or a bond for the life of the tower.
