The covenants and form deeds are now okay and meet the relevant Requirements in the County Attorney's Office Water Review.

There is one issue with the QCD that was recorded to cure title. It gives a general quarter section reference for the legal description, with a reference that the full description is attached at Exhibit A. Unfortunately, that Exhibit A was not recorded. Please provide us with the corrected QCD. Once that is done, my concerns about the need to cure title in Requirement A of our Water Review will be addressed.

Besides the QCD, the remaining outstanding issue in terms of the Requirements in our Water Review is providing proof that the existing well has been addressed. By separate e-mail, you advised that you have submitted the well permit application. We will have to have the results of that—issuance of a new well permit pursuant to the augmentation plan, I presume, before the plat can be recorded.

CGS's 11/8/2019 Tanja Curtis Minor Subdivision (MS195) comments have been satisfactorily resolved. However, since there are now multiple versions of RMG's geology and soils report, CGS recommends that Surveyor's Note no. 22 on sheet 1 of the plat be revised to specifically reference the most recent (12/9/2019) version: Geology and Soils Study with Wastewater Study, Curtis Subdivision, Filing No. 1, Monument, Colorado (Rocky Mountain Group [RMG], December 9, 2019).

The sheet numbering on the plat is incorrect. Sheet 1 should be corrected to Sheet 1 of 2 (not sheet 1 of 1)

The Tanja Curtis Minor Subdivision site (two-lot subdivision of 37.11 acres, physical address 1920 E. Baptist Road, Monument) contains moderate 10-30% slopes but, as noted previously, is not exposed to any geologic hazards or unusual geotechnical constraints that would preclude the proposed residential use and density. CGS reviewed RMG's Geology and Soils Study with Wastewater Study, Curtis Subdivision, Filing No. 1 (October 11,2019). We have several comments:

1. RMG's and Geoquest's characterizations of groundwater conditions are contradictory. RMG states (pages 7-8), "Groundwater and permanent or seasonal water was encountered in Profile Pit #2 at a depth of 3.5 feet." Geoquests's OWTS profile pit logs indicate saturated conditions at 42 inches, but the Profile Pit Findings states "Groundwater was not encountered during the inspection." CGS recommends that the county request clarification and, if necessary, correction.

2. RMG states (page 11) that "The Soils Report by Geoquest, LLC recommended that if expansive soils/bedrock were encountered overexcavation and replacement with 4-feet of non-expansive structural fill would be required." Since shallow claystone, described as moderately expansive, was encountered in both of Geoquests's borings TH-1 and TH-2, overexcavation will likely be required. As discussed by Geoquest, overexcavation and replacement should extend at least four feet beneath foundation bearing elevations and floor slabs, and four feet laterally from foundation walls.

Forsgren's Geology and Soils Report for 1920 E Baptist Rd, LLC (May 16, 2019) is based entirely on NRCS Soil Survey data, which is typically valid for only the uppermost five feet below the ground surface, and is not valid for use in design of structures.

Potential development constraints include: soils and bedrock containing layers and lenses of expansive clay minerals, erosion, and soils mapped as moderately corrosive to uncoated steel.

CGS recommends that the county require lot-specific geotechnical investigation, testing and analysis for use in design of individual foundations, floor systems, subsurface drainage, pavements, etc.
