The Black Forest Land Use Committee is opposed to this lot line reinstatement and recommends DISAPPROVAL of the request.

The Black Forest Preservation Plan states, "Residential densities in this planning unit (the timbered area) should be strictly held to an overall average of one dwelling unit per 5 acres." Even if the parcel was once 2.5-acre lots, it is not in conformance with the Preservation Plan to go back to 2.5-acre lots. The zoning is RR-5 for 5 acre lots.

The applicant's representative is incorrect in stating that this parcel is surrounded by 2.5-acre lots. The lot directly west is 2.5 acres and beyond that to the west is a 5-acre lot. The lot to the north is 3.6 acres, the lot to the south is 4.37 acres and the four lots directly across Black Forest Road to the east are 4.78, 4.78, 4.78 and 9.56 acres. All four of the lots to the east were originally 5-acre lots or larger but the section line road took a portion of the lots for right-of-way so that is the reason three of them are slightly less than 5 acres.

Therefore, the six lots surrounding this parcel average 5.73 acres, far more than 2.5 acres as stated by the applicant.

This proposal is clearly not in conformance with existing densities, zoning, or the Preservation Plan.

The Land Use Committee strongly recommends DISAPPROVAL of the lot line reinstatement.
