Based on the information we have, we cannot complete a water review for this proposed subdivision, and the proposed supply is insufficient. While Applicant may have enough Arapahoe aquifer water adjudicated in Determination of Water Right No. 3344-BD, they do not have enough water approved for use in the proposed subdivision in their replacement plan, Replacement Plan--Determination of Water Right No. 3344-BD. Applicant proposes 2 lots each using 0.5 acre-feet of not nontributary Arapahoe aquifer water. There is an existing exempt well Permit No. 304886 that the State Engineer says either has to be abandoned and plugged or re-permitted under a Replacement Plan—but a different Plan than the existing one under No. 3344-BD. The Replacement Plan only provides for water for 1 lot—not 2—to withdraw 0.5 acre-feet annually from the Arapahoe aquifer (see, Para. 18 of Plan). Although the Plan states pumping from the Arapahoe aquifer is limited to 300 years (see Para. 22), the Plan is only for 100 years instead of the County’s required 300 years (see Para. 28 of Plan). Depletions during pumping are to be covered by return flows from non-evaporative septic systems; however, no provision is made to address post-pumping depletions in the Plan. It is likely that the Replacement Plan needs to be amended to provide the supply Applicant wants for this proposed subdivision.

The State Engineer, in its letter dated August 15, 2018, makes erroneous conclusions based on a misreading of the Replacement Plan. The Engineer states: “The Replacement Plan . . . allows diversions totaling 1 acre-foot annually from the Arapahoe aquifer for a period of 300 years split between two proposed wells on two residential lots. Each well is allowed to divert 0.5 acre-feet annually to serve 1 single family residence, irrigation of 3,000 square-feet of lawn and garden, and watering of 4 large domestic animals.” There is no such allocation for 2 residences in the Replacement Plan. Regarding a request for approval of a final plat for Cordero Minor Subdivision, Enumerations has the following comments:

1. The address shown for proposed Lot 1 is incorrect. The correct address for the existing residence is 2320 N. Ellicott Hwy. per the official address change performed in April, 2016.
2. Prior to recording, Enumerations will review the mylar for addressing, title block, street names and floodplain statement. No Enumerations fee will be due since the addresses are existing.
3. Provide a copy of the recorded plat for our records.



Floodplain has the following comments:

1. New FEMA FIRM panels recently became effective for El Paso County. The floodplain statement should be updated to show the new information: panel number 08041C0825G with an effective date of December 7, 2018.
2. Per Regional Building Code, the floodplain area on Lot 1 must be labeled with “No Build Area” and “No Storage of any Materials”.

The site does not contain steep slopes, is not undermined, and does not contain, nor is it exposed to, any geologic hazards that would preclude the existing and proposed residential use and density. Colorado Geological Survey therefore has no objection to approval of the two-lot subdivision as proposed.

An intermittent drainage and a sand wash are located within the northeastern portion of proposed Lot 1, east of the existing Lot 1 building location. Applicant's Letter of Intent (October 21, 2016) states no additional structures are currently planned.
