The previous opposition from the Black Forest Land Use Committee to this Special Use Permit was based on incorrect information about the situation and a lack on this chairman's part to interview the applicant personally to get the whole story. I saw the property more than once but did not talk to the applicants.

After hearing the applicants story at the Planning Commission and talking to the applicant during a break, I realized this was a valid and reasonable request for a Special Use permit so I spoke in favor of it at the Planning Commission.

After further consultation with the Land Use Committee, we would like to recommend approval of this Special Use Permit.

Black Forest Land Use Committee

The Black Forest Land Use Committee is on record as OPPOSING the Special Use Permit for the Reimers Contrator's Equipment Yard. This request is totally out of place in the residential neighborhood where it is located.

The violations of the Special Use rules are quite clear on this issue:

Not Consistent with Master Plans - The master plan for this area is the Black Forest Preservation Plan and the Plan clearly calls for rural, residential lots 5 acres or larger in this timbered area. Commercial activity is clearly specified in the Plan to be centralized at the intersections of Black Forest Road and Burgess as well as Black Forest Road and Shoup. The Land Use Committee is not opposed to home businesses as long as they do not generate traffic, congestion, or disruption to the neighbors. This request does not meet that criteria.

Not consistent with zoning district - The zoning is RR-5 which is only residential in nature and has no provision for commercial activity or storage. A Special Use Permit to permit this construction activity and storage is a defacto rezoning to a commercial zone, a clear violation of the Preservation Plan and zoning regulations.

Not in harmony with the character of the neighborhood - The neighborhood is wooded except for those who lost trees and homes in the Black Forest fire of 2013. These timbered lots are prized for their solitude, beauty, wildlife and privacy. Even on lots that were burned, residents are removing burned trees and rebuilding their homes in an effort to recover from the fires. Approval of this request would be much the same as approving a contractor's equipment yard in the Briargate neighborhood. The fact that this is a larger lot than Briargate does not diminish the absurdity of the example. The Land Use Committee has supported multiple Special Use requests that involved dog kennels, horses, therapeutic riding stables and other activities that fit within the rural, residential flavor of the Black Forest. A construction activity and storage facility is definitely not within those guidelines.

Over-intensive use of land - The large block wall and berm are similar to building a huge storage warehouse on this land and is not in keeping with Special Uses that might be permitted. The blockage of the view because of the berm and block wall also falls within a misuse of the land. The over-intensive use the land also diminishes the value of the surrounding properties.

In addition to clearly violating the Special Use rules, the applicant has not shown consideration or courtesy to the neighbors.

- The berm and block walls are directly on the property lines of next door neighbors and along Herring Road. No attempt has been made to move this activity and location further from neighbors.

- Loud, late-night parties that were not toned down with a phone call. In fact the applicant or his guests made the problem worse by driving up and down the street making even more noise.

- The applicant has encroached on a neighbor's property with his large berm.

- The applicant encroached on a neighbor's property with the foundation trench for the block wall.

- The applicant has had multiple incidents of firearms use which cause safety and noise concerns for neighbors.

- The applicant's lot is a corner lot, making it difficult to hide the equipment activity. The nature of the lot makes it impossible to completely hide the equipment even if the location were to be moved.

This construction equipment operation and storage, coupled with disregard for the rights of neighbors demands that this Special Use Permit be DENIED. The lot is simply not large enough to mask the noise or visual disruption of the forest environment. This type of activity should be placed on a commercial lot outside the forest or on a large parcel on the eastern plains.
