minor comments on Final Plat, please make minor changes and submit a black and white copy only for Planning Commission and BoCC hearings.

Drainage Letter, Maintenance Agreement, and OWTS require signatures and resubmittal

Check County Attorney comments in regards to Covenants, update and resubmit for review.

If final plat is approved, a mylar will need to be created with the surveyor's stamp and signature, the owners signature, a new title commitment dated within 30 days, zero balance ad valorem tax certificate, enumerations stamp, and drainage, park, and school fees, an fees for recording. After approval from BoCC contact planner to schedule a meeting.

Please provide a revised draft that is more responsive to the Requirements and resend to the County Attorney's Office for review. Also, please provide draft form deeds for County Attorney review. Regarding a request of approval of the Poenitsch Subdivision, Enumerations and Floodplain have the following comments:

1. Neither Enumerations nor Floodplains comments from the first submittal were addressed. The street name approved for the access easement and the addresses therefrom, are not shown on the plat. The floodplain statement still shows the incorrect FIRM panel.

The Black Forest Land Use Committee recommends approval of the minor subdivision.

One input we would like to make is to ask why they couldn't have an access off Shoup Road for the western lot? This lot will need to be accessed by crossing two lowlands in the current configuration. The lot had an access off Shoup Road before the fire and we feel this could be grandfathered into the proposal. Then the other two lots could be accessed off Herring Road.

General Comments:
at the end of the review process and if approved a recording meeting will need to be scheduled, the mylar with all owners signatures, the surveyor stamp, enumerations sign off, a new Title Commitment dated within 30 days, a zero balance certificate for ad valorem taxes, all associated fees, ie drainage, bridge, school and park fees and recording fees, will be required.

There is an issue with the total acreage, The assessor's website and the water resources report indicates 18.66, but all other documents indicate 18.86 acres. Please verify total acreage and update associated documents. If the acreage is correct on specific documents, please upload the document again.

Thank you for the opportunity to review Mullins Minor Subdivision. Goal A.4.3.A. of the Trails Addendum to the Black Forest Preservation Plan is for provision of neighborhood trails in new developments that can ultimately connect to the regional trail system. Recommend adding to the Final Plat a trail easement over the 20-ft utility easement on the east side of Lot 3. A trail corridor along Herring Rd can ultimately connect to the east-west route from Herring to The Pineries Open Space along Forest Heights Circle and through Redtail Ranch.

Regarding a request for approval of a final plat for Poenitsch Subdivision, Enumerations has the following comments:

1. The street name of Grace Hills Pt. has been approved for the access road in this subdivision and addresses have been assigned based on this access. Both these addresses and the street name should appear on this plat. If the access to any of these lots changes to a different street, then new addresses will need to be assigned.
2. Prior to recording, Enumerations will review the mylar for addressing, title block, street names and floodplain statement. An Enumerations fee of $10 per lot addressed will be due at the time of mylar review.
3. Provide a copy of the final recorded plat to Enumerations for our records. Enumerations will not approve any building plans submitted for review/permit without a copy of the final recorded plat in our records.



Floodplain has the following comments:

1. The FEMA panel number shown on the floodplain statement is incorrect. The correct panel numer is: 08041C0325G.

The site is not exposed to any geologic hazards or geotechnical constraints that would preclude the proposed three-lot residential subdivision. CGS therefore has no objection to approval. CGS agrees with GWI's 3/5/18 recommendation (Soils and Geology Evaluation for Poenitsch Minor Subdivision, page 4) for an erosion setback from drainages, corresponding to the flood-prone areas shown on the Poenitsch Subdivision plat (Oliver E. Watts, Consulting Engineer, 11/22/2018).

The geotechnical (foundation, floor system, surface and subsurface drainage) recommendations in Parr Engineering & Consulting's 6/19/2018 Subsurface Soil Investigation are valid for proposed Lot 1. Once building locations have been identified on Lots 2 and 3, additional investigation and analysis are recommended for use in design of foundations, floor systems, subsurface drainage, etc.

The Black Forest Land Use Committee recommends approval of this request with the following comments:

1. We recommend that the western lot be permitted to have a driveway access off Shoup Road. Using the flag entrance off Herring results in the need to cross two drainages, one of them very large, in order to access the buildable area.

2. The Letter of Intent sounds like the development will be sharing one well. We have talked to people who were consultants in the proposal and understand that the development will require 3 separate wells and septic systems.

The Colorado State Forest Service recommends that all forested acres be mitigated to reduce the risk of wildfire and that defensible space be created for each dwelling using the standards in “Protecting Your Home From Wildfire: Creating Wildfire-Defensible Zones“ FIRE 2012-1 located on the Colorado State Forest Service website.

In addition, I recommend that all wildfire mitigation be completed before or during dwelling construction.

Standing dead trees, remaining from the Black Forest fire should be mitigated for safety concerns.
