Articles of Incorporation and Bylaws of HOA are approved by CAO.

Quitclaim Deed and Assignment needs to be redrafted as Special Warranty Deed. 3 deed versions are required. Please see comments in attachment.

Declaration of Restrictive Covenants require changes as redlined in attachment.

CAO needs to review/approve revised SWD's and Covenants before final plat is recorded.

Awaiting review from County Attorney for all new documents submitted with last submission

Once those documents are resolved and a water sufficiency finding is secured by the County Attorney we can schedule for public hearing,

If approved a recording meeting is required, the mylar with all owners signatures and the surveyor stamp, stamped by enumerations, zero balance tax certificate from country treasure's office, a new title commitment dated within 30 days, and all fees to include park drainage and bridge, and school fees, will be due along with the recording fee.

Regarding the private driveway agreement, I recommend that the applicant either consult an attorney or work with Gabe to find a past example of a shared driveway easement. Because there is only a single property owner at this time, it is not legally possible to have an "agreement." Enumerations/Floodplain has the following comments:

1. It was Enumerations understanding that the access to lots 2 & 3 were coming from the easement be between lot 1. Looks to be coming from in between lots 4 & 5 now. If this is not accurate please notify this department, this will affect the addressing arrangement.
2. A permanent sign should be posted at the access easement in between lots 4 & 5 with addresses to lots 2 & 3 pointing west down the easement.
