The site does not contain, nor is it exposed to, any geologic hazards that would preclude the proposed replat. CGS therefore has no objection to approval. Plat note 6, requiring structural foundations to be located and designed by a professional engineer, is appropriate. 9/16/2019 9:57:14 AM

The request for an additional plat note regarding the remainder parcel not being a part of this action and requiring separate subdivision action has not been included.

Provided the County Attorney and EPC Health have no additional comments/concerns and can make a positive recommendation, staff anticipates this item being scheduled for the 10/16 PC hearing date. If you have a conflict with this date please contact Nina to let her know.

Original drainage basin fees were calculated based off of an incorrect basin identified. This site is within the Falcon drainage basin.

The calculated drainage fee is $7,441 and bridge fee is $1022 (5.105ac at 0.07% impervious, with a 25% reduction factor).

Prior to further review additional information is required from the county on whether the county is seeking the applicant to modify well permit no. 191102 to limit the annual withdrawal to 0.33 acre-feet per year. 6/19/2018 5:44:04 AM

Replat: In the proposal-Lot 18 is vacated and Lot 18B is created by replat, but remainder of Lot 18 is not addressed. There will now be an original subdivision plat showing Lot 18 and the Replat showing Lot 18A, but how does remainder now become Lot 18? It seems that Replat should include both Lot 18B and remainder of Lot 18. Also-how does original purpose of Lot 18—Park Area For Public Use—get converted to private use simply by a previous deed and now vacation and replat. Does remainder of Lot 18 remain Park Area?

Water: Applicant has not provided for 300 year water supply for the subdivision. The water supply is insufficient. Well permit allows pumping of 1.0 acre-feet /year. That has to be converted to comply with the County’s 300 Year Rule. I understand that the State sees this as a valid well permit issued in 1995, so there has been historic pumping. And I believe the SEO does not put an administrative life on exempt wells. But for our purposes, we have to look at the 1.0 acre-feet/year through the lens of our Rule, and therefore, it needs to be reduced to 0.33 acre-feet/year. I don’t understand why the SEO did not review the proposed supply against our 300 Year Rule requirement. Applicant has to agree to reduce its demand to 0.33 acre-feet/year, they have to fill out a new Water Supply Information Summary for that amount, the Well Permit has to be modified to impose the reduction, and the SEO has to do a new water review. The Upper Black Squirrel Creek Ground Water Management District's only concern is that the applicant needs to make sure they have an adequate water supply for the plans that they have submitted that are allowed for a small capacity well. The applicant will only be allowed .5 acre-feet of water per year for a 5 acre parcel per our Rules unless there is a water sufficiency letter stating otherwise. 1/10/2018 10:03:43 AM
