General
1.There is now separate ownership for the commercial versus the residential zoned property. This division of land is considered an illegal division of land per State Statutes and El Paso County Subdivision Regulations. No building permits will be issued on the land until the division of land is legalized through the subdivision process. We understand this is the intent of the property owners.

Additional comments and redlines will be provided upon completion of the PCD Engineering review.

Per conversation with the Design Engineer, the drainage deviation request regarding backyard flow would be denied as presented. As discussed, the anticipated modification to the drainage design are as follows:
a. Backyard flow along the southern property line will drain into an on-site WQ facility. No lot fencing will be located in the ditch which would impede flow; therefore, the drainage swale will be located within a tract along the southern line with the final plat to convey backyard flows into the WQ facility.
b. Drainage along the western property line to be routed into the extended detention basin.
c. Update the drainage report narrative/calculations accordingly.
d. The preliminary grading and drainage report/map may be updated to show the proposed modification schematically in lieu of updating the proposed contours.

* (Unresolved) With an early grading request submit a Financial Assurance Estimate Form.

* Based on the updated preliminary drainage report the EDB will now be constructed with the final plat. Therefore previous comments to submit the SDI, MS4 Post Construction Form, & O&M are no longer applicable with the preliminary plan. Pond Construction Drawings which was reviewed with the previous submittal is no longer applicable with the preliminary plan and will be reviewed for approval during the final plat application.

* Include the County standard signature block and construction notes in the Off-Site Water Plan and Sewer Plans. Portions of the work are within the County ROW and approved construction drawings are required to obtain a work in the ROW permit.

Regarding a request for approval of a preliminary plan for Waterview East, Enumerations has the following comments:

1. All street names for this development must be approved by Justin Annan (jannan@elpasoteller911.org). Submit a list of proposed street names to him. An email from him confirming approval of street names for this project is required before addresses can be assigned.
2. Provide a copy of the overall development to Enumerations once street names have been approved for addressing. Indicate with (xxxx) the location of each lot and tract where an address will be required. Clearly indicate any lots where the home will be rear loaded on the plan.
3. Two of the streets in this development seem to be planned to continue to the south and two of the streets seem to continue to the east. If possible, please provide details on any developments these streets will continue into so that addresses can be assigned consistently along those streets.

1. Per title commitment #9, the mineral rights appear to be partially severed. All mineral rights owners must be notified of the request.
2. The sketch plan and rezone must be approved prior to the preliminary plan (may be heard on the same day).
3. The noise study should be a final version and not a draft version.
4. The noise barrier fence will be a condition of approval, as recommended by the noise study submitted to reduce noise levels along Powers Blvd.
5. In the letter of intent please expand upon the purpose of the pump station and include reasoning why it is not subject to a 1041 permit.
6. Please review the current plans for the adjacent parcels to ensure your proposed access points align with theirs.
7. Once engineering has completed their review redline drawings will be uploaded.
8. Be aware that with the final plat you will need to submit the petition for inclusion into the PID to Lori Seago (attach the word version of the legal). There will be an additional fee to the Attorney office for the publication. A note will need to be placed on the plat outlining the inclusion within the PID. Prior to the plat being recorded, the plat will be presented to the assessor who will add the PID to the taxing entities.

FMIC addressed previous drainage issues from the Waterview Filing's No. 5 & 6 development projects with a letter dated 12/19/13. This letter addressed FMIC concerns with proposed developed flows from the Waterview projects being detained on-site, discharged at historic rates via point discharge points but with greater developed flow volumes. The downstream recipient of this greater volume of water is FMIC's Big Johnson Reservoir. FMIC not only receives the excess water, they also receive excess silt as this excess volume of water crosses over undeveloped open space property prior to entering the reservoir. As with Waterview Filing No. 6, FMIC entered into a "Storm Water Drainage Impact Agreement" to accept this except volume of water from the proposed Waterview East portion that drains into the Big Johnson Reservoir. A similar Agreement will need to prepared and approved between FMIC and the applicant/owner for that portion of Waterview East that discharges storm water into Big Johnson Reservoir. 11/28/2017 2:30:22 PM
