Several years ago the Land Use Committee drew a curved line to show the dividing line between the Walden/Spruce Hill area and the Northern Grasslands in this area when considering Grandview. That line is shown by the blue line on the attachment. Even though the Preservation Plan says the dividing line is the ridgeline, that ridgeline is vague and indefinite. Have you ever seen it in person? I have walked the property and the land is gradual in its rises and valleys.

We decided to use the blue line since the topography was so gradual and thus we support the 10 lots for Abert Ranch. If you notice on the topographic line that supposedly shows the ridgeline, there is a bulge to the west that goes into Grandview. Technically this might be considered to be in the Northern Grasslands and thus need to be 5-acre lots. It was approved for 2.5 acre lots. Several of the lots inside this bulge in Abert Ranch are 3 acres or larger so we believe it would be fair to let Abert Ranch have the 10 lots to be fair and consistent with Grandview.

Planning staff has discussed the Abert Ranch project with the Director and Planning Review Manager. there is concern regarding consistency with the Black Forest Preservation Plan sub-area no. 6. The attached map identifies the physical drainage basin line which is reflected in the sub-area discussion of the small area plan. The proposed lot sizes within Abert Ranch is not consistent with that plan. Staff suggests increasing the lot sizes to 5 acres (decreasing the larger to 5 acres) to be more consistent with the sub -area plan with the smaller lots 2.5-3 acre at the western edge of the Abert development.
Ultimately, staff identifies how each application is compliant with the LDC and how it is not. Staff does not provide recommendations to the hearing bodies.
Additionally Staff has discussed the 30' access to the Morehead property and has been advised that it appears to be sufficient because there is a stub-out off of Silver Nell to the vacant properties north of Grand View and a stub out from Walden to those vacant parcels.
