As noted on previous Amara submittals, development of the proposed annexation areas will result in impacts to County roads and drainage infrastructure.

Drainage:
1. Part V of the Draft Annexation Agreement:
a. Please include requirements for a Drainage Basin Planning Study (DBPS) for Upper Williams Creek in the annexation agreement. (Note that the previous City response was "Yes.") The DBPS will involve multiple proposed developments, jurisdictions, and agencies as owners and stakeholders. A cross-jurisdictional drainage fee structure may be preferable if development within the drainage basin will be occurring in the City of Colorado Springs, El Paso County, and Fountain. County Staff is open to discussion on fee structure and implementation.
b. Closure of Upper Williams Creek as mentioned in the agreement would seem to negate the purpose of the DBPS, and County Staff would provide this input to the Drainage Board if the developer requests closure of the basin.
2. Development of the annexation areas will need to address any offsite drainage impacts in unincorporated areas and necessary improvements and/or fair share contributions towards necessary improvements. The effects of urban development on the drainageways downstream of the development area will need to be considered as the project develops, and protections or contingency plans adopted to ensure that any erosion (due to increased base flows and runoff volumes) or flooding issues in unimproved drainageways can be addressed in a timely manner.

Traffic/Transportation
1. The County roads that will be impacted by development of the Amara annexations will need to be addressed in traffic impact studies with each respective development area. Most of the roads that will be impacted have already been annexed into Colorado Springs or Fountain.
2. The condition and adequacy of any County roads serving the annexation areas will need to be addressed and improvements and/or fair share contributions may be required as applicable with any County access permitting process.
3. In regard to multiple statements in the annexation agreement that the owner may seek cost recovery or reimbursement for road construction, Staff is not aware of any County program or process through which that would be available for road construction by a City developer. City and County developers may enter into private cost-sharing agreements. The Bull Hill development north of Lorson Ranch may need to construct the portion of Meridian Road between Bradley Road and Fontaine Blvd. before Amara development, which is a likely road for such an arrangement depending on phasing and lanes needed.
4. The annexation agreement also contains multiple statements that the developer's offsite road construction responsibilities would expressly exclude land acquisition costs; will the City or some other entity be responsible for providing the necessary rights-of-way?
