The available referral documents include the PUD Development Plan (HR Green Development, LLC, March 12, 2024), Letter of Intent (HR Green Development, LLC, March 21, 2024), Preliminary Grading Plans (HR Green Development, LLC, March 13, 2024), and other documents. CGS previously reviewed the Soil, Geology, and Geologic Hazard Study (Entech Engineering, Inc., March 8, 2022) and provided comments dated December 5, 2023. We offer the following additional comments:

1. The Geologic Hazard note on the PUD Development plan references a revised report by Entech dated January 15, 2024. This report was not provided in the referral documents. CGS would appreciate a copy for our review/files. Lots located within areas of geologic hazards/constraints should be indicated on the plat.

2. Table 3 of Entech’s previously submitted report (March 8, 2022) indicates that groundwater was encountered in Test Boring 6 at a depth of 13 feet, however, in other areas in the report, Entech states that groundwater was not encountered. As previously stated, CGS recommends the county require groundwater monitoring/observation to obtain groundwater data to verify that proposed floor levels are at least three feet (preferably 5 feet) above maximum anticipated groundwater levels and maintained year-round. To be effective, however, this monitoring should include measurements/observations through fall, winter, and spring and not merely during site-specific building investigations.

3. Multiple drainages exist within the project area that are designated as existing wetlands per the National Wetlands Inventory (U.S. Fish and Wildlife Service, National Standards and Support Team, wetlands_team@fws.gov). Erosional setbacks should be established near drainages and noted in the plans.

4. Based on the Letter of Intent (page 17), “the exact source of water to be dedicated to the proposed development has not been finalized.” However, it is anticipated that water will be sourced from wells drilled within the Arapahoe and Laramie-Fox Hills. The availability of groundwater for huge developments such as this can be problematic and is becoming more so due to drought and dwindling water resources. CGS recommends that the basis of assumptions of available groundwater for this project be provided to the county for review before approval of final plans.

1. Enumerations will require a large scale plan for the entire phase 2 development be delivered to the Enumerations department for addressing purposes. Amy’s work place location is 3939 Cordera Crest Ave.
2. Re-addressing fees will apply at the time of the review of the mylar, prior to plat.
3. Per Jolene Leno with El Paso County Department of Public Works, will require a renaming of the street name Rubble Drive to Holmes Road from filing No. 1. Contact her for more clarification. Jolene Leno joleneleno@elpasoco.com Any clarification should be sent to Enumerations to move forward. No existing addresses should be affected.
4. Street names that are not on the approved list from E-9-1-1 are : BARKIE LANE, FORE LANE.

Overarching comment regarding water and wastewater documentation. There are several preliminary plan criteria of approval that cannot be met at this stage if responsibilities for water and wastewater services are not able to be identified at this time. Criteria are listed as a comment on the front page of the LOI. You will need to propose to defer these review criteria to subsequent final plat stages. If you elect to proceed in this fashion, you will need to update the LOI to indicate that the FHN metro district shall enter into an intergovernmental agreement (IGA) with Cherokee or Triview. The IGA shall be recorded prior to recording of any final plats within the plan area. This will be a condition of approval for the PUDSP. While reviewing documents, BFFRPD discovered what appeared to be outdated and non-EPCo LDC compliant verbiage concerning water for fire protection. We contacted the applicant(s) directly and attempted to contact the EPCo Project Manager to seek clarification. Upon conversations with applicant(s) regarding this project and another adjacent project, the applicant(s) are working on revising documentation/plans to comply with EPCo LDC. EPCo maintains Authority and jurisdiction of El Paso County Land Development Code and therefore applicant will likely be seeking clarification and guidance from EPCo on conformance to code requirements.

The available referral documents include the PUD Development Plan (HR Green Development, LLC, November 6, 2023), Letter of Intent (HR Green Development, LLC, November 4, 2023), Preliminary Grading Plans (HR Green Development, LLC, October 25, 2023), Soil, Geology, and Geologic Hazard Study (Entech Engineering, Inc., March 8, 2022), and other documents.

We understand that the applicant desires to develop 196 single-family residential units, with some commercial parcels and a hotel on 747.3 acres located to the southwest of Hodgen Road and Black Forest Road. Entech identifies areas that will impose geologic constraints that including (page 1) “seasonal and potentially seasonal shallow groundwater areas, drainage areas, areas of ponded water, floodplain, erosion, artificial fill, expansive soils, and areas of downslope creep.” Entech’s characterization of the geologic hazards and constraints associated with the site is valid. Provided Entech’s recommendations are adhered to, CGS has no objection to approval of the PUD Development plan as proposed. We offer the following comments:

1. The Geologic Hazard note on the PUD Development plan should be updated to reference Entech’s March 8, 2022 report and the geologic hazards listed in that report.

2. Table 3 of Entech’s report indicates that groundwater was encountered in Test Boring 6 at a depth of 13 feet, however, in other areas in the report, Entech states that groundwater was not encountered. Even so, groundwater levels tend to fluctuate, and perched water is likely to collect above clayey, less permeable soil layers on top of the bedrock surface. If basements are being considered, CGS recommends the county require groundwater monitoring/observation to obtain groundwater data to verify that proposed floor levels are at least three feet (preferably 5 feet) above maximum anticipated groundwater levels and maintained year-round. To be effective, however, this monitoring should include measurements/observations through fall, winter, and spring and not merely during site-specific building investigations.

3. CGS agrees with Entech (page 10), “In areas where high subsurface moisture conditions are anticipated periodically, subsurface perimeter drains are recommended to help prevent the intrusion of water into areas below grade.”

4. Erosional setbacks should be established near drainages and noted in the plans.

1. When printing off and taping the project together for Enumerations purposes, sheet 22 is not at the same scale. From page to page the same street names are not being used on the same street.
Please provide a 100 scale copy of the development on one sheet of paper to the Enumerations department for addressing purposes. If you are to mail this item, I am located at our new office at 3939 Cordera Crest Ave, 80924. Thank you.
2. Since part of the area has been reconfigured and the addressing was assigned based on an old configuration, re-addressing fees will apply to phase 2, filing no 3.
3. Existing lot 74 & 80 from filing No 1 has the platted cross streets as Rubble Drive & Old Stagecoach Road. This proposed development shows the cross streets as Holmes Road & Old Stagecoach Road. Will this plat take care of the street name change or will an official street name change need to occur? I am going to consult with D.O.T and will give you an update on the next review. Please have a conversation with Development Services and see what they suggest.

The Colorado State Forest Service recommends that all forested acres be mitigated to reduce the risk of wildfire and that defensible space be created for each dwelling using the standards in the CSFS "Home Ignition Zone Guide" (formerly known as "Quick Guide FIRE 2012-1: Protecting Your Home From Wildfire") located on the Colorado State Forest Service website.

RBC313.18.5 Subdivision Proposals.
FEMA approved base flood elevation data and 100-year floodplain boundaries shall be provided and shown on plats
for subdivision proposals and other proposed developments that contain at least fifty lots or five (5) acres, whichever is less;
All buildable lots less than two and one half (2½) acres in size are required to be located entirely outside of the 100-year floodplain. Lands within the 100-year floodplain shall be established in a tract, and require that the owner maintain the tract. Buildable lots two and one half (2½) acres and larger, are required to have the 100-year floodplain contained in a drainage easement dedicated by plat in the name of the governing body with the restrictions of “No Build” and “No Storage of any Materials”;

The parcel is located within the current effective Zone A floodplain with no BFEs(no supporting model available). Draft model backed BFEs for this area have been developed as part of Phase 1 for the ongoing El Paso County, CO, Risk MAP Project”. The data has been reviewed and approved through FEMA’s QA/QC process (May 11, 2022) and is currently in the MIP (Case No. 19-08-0037s). The Phase 1/Base Level Engineering outputs and Zone A ready deliverables are, under the following folder:
