The available referral documents include the Final Plat (Edward James Surveying, Inc., April 18, 2024), Letter of Intent (HR Green Development, LLC, March 5, 2024), Soil and Geology Study and Wastewater Study (Entech Engineering, Inc., March 5, 2024), and other documents. We understand that the applicant desires to develop 51 single-family residential estate lots on 166.4 acres located at the south end of Allen Ranch Road due south and west to Quartz Creek Drive. CGS provided comments dated December 14, 2023 and April 3, 2024, which are generally repeated herein:

1. Note 27 on the final plat should be updated to reference Entech’s March 5, 2024 report and the geologic hazards/constraints listed with mitigation measures. Lots impacted by geologic hazards/constraints should be indicated on the plat. Downslope creep and seasonally wet areas are geologic constraints not currently listed on the final plat.

2. Table B-1 of Entech’s wastewater study indicates that groundwater was encountered in Test Pit 3 at a depth of 4 feet, however, in other areas in the report, Entech states that groundwater was not encountered. Even so, groundwater levels tend to fluctuate, and perched water is likely to collect above clayey, less permeable soil layers on top of the bedrock surface. If basements are being considered, CGS recommends the county require groundwater monitoring/observation to obtain groundwater data to verify that proposed floor levels are at least three feet (preferably 5 feet) above maximum anticipated groundwater levels and maintained year-round. To be effective, however, this monitoring should include measurements/observations through fall, winter, and spring and not merely during site-specific building investigations.

3. CGS agrees with Entech (page 9), “In areas where high subsurface moisture conditions are anticipated periodically, subsurface perimeter drains are recommended to help prevent the intrusion of water into areas below grade.” Individual foundation perimeter drains are intended to handle small amounts of intermittent, perched water and may NOT be used to mitigate persistent shallow groundwater conditions.

The Colorado State Forest Service recommends that all forested acres be mitigated to reduce the risk of wildfire and that defensible space be created for each dwelling using the standards in the CSFS "Home Ignition Zone Guide" (formerly known as "Quick Guide FIRE 2012-1: Protecting Your Home From Wildfire") located on the Colorado State Forest Service website.

1. Standard development plan Comments;
a. Provide a 100 scale copy or larger of the entire APPROVED development plan (d.p.) to this department so that addressing can be assigned. Once received, the development plan will be placed on a list to be addressed. Development plans that are not yet approved may be addressed, however additional plan review fees will accrue if changes are made to the D.P. after initial addressing.
b. I believe CSU provides gas to this area. If underground service is needed prior to plat, submit a Utilities Addressing Plan (UAP), to Colorado Springs Utilities via the related link at https://www.csu.org/Pages/GISMapping.aspx For more information contact: Jade Swan jswan@csu.org

2. Flying Horse North Fil. No. 1, was initially addressed with a different configuration. Due to the changes, additional Enumerations addressing fee will be added to the plat fees. Typically, a $50.00 fee, depending on the time it takes to re-address the new area.
3. Existing Lot 1, Flying Horse North Fil No 2, address will not need to change with this new configuration.
4. On sheet 4, when cutting and pasting the project together, with Fil. No. 1, it seems as though, tract A is overlapping with lot 50. Each page is at 100 scale but this does not fit correctly. The piece for tract A is moved more to the east and north and Allen Ranch Road is not connected. Is Allen Ranch Road intended to connect in this location?

5. Standard Final Plat Comments: NEW OVER THE PHONE FEES-please read.
a. Enumerations will review the pre-plat (mylar) prior to plat for address placement, street names, and title block.
b. A $10.00 per lot and tract platting fee will be due at the time of the review of the pre-plat, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of December 5th 2023, the fee for all credit/debit cards has changed from the flat 2.95% fee to the following: Over the phone Credit/Debit Card payments will be 2.3% and In-Person Debit Card payments will be 1.5% (in-person only).
c. A copy of the final recorded plat is required prior to plan submittal for RESIDENTIAL. 1. Standard development plan Comments;
a. Provide a 100 scale copy or larger of the entire APPROVED development plan (d.p.) to this department so that addressing can be assigned. Once received, the development plan will be placed on a list to be addressed. Development plans that are not yet approved may be addressed, however additional plan review fees will accrue if changes are made to the D.P. after initial addressing.
b. I believe CSU provides gas to this area. If underground service is needed prior to plat, submit a Utilities Addressing Plan (UAP), to Colorado Springs Utilities via the related link at https://www.csu.org/Pages/GISMapping.aspx For more information contact: Jade Swan jswan@csu.org

2. Flying Horse North Fil. No. 1, was initially addressed with a different configuration. Due to the changes, additional Enumerations addressing fee will be added to the plat fees. Typically, a $50.00 fee, depending on the time it takes to re-address the new area.
3. Existing Lot 1, Flying Horse North Fil No 2, address will not need to change with this new configuration.
4. On sheet 4, when cutting and pasting the project together, with Fil. No. 1, it seems as though, tract A is overlapping with lot 50. Each page is at 100 scale but this does not fit correctly. The piece for tract A is moved more to the east and north and Allen Ranch Road is not connected. Is Allen Ranch Road intended to connect in this location?

5. Standard Final Plat Comments: NEW OVER THE PHONE FEES-please read.
a. Enumerations will review the pre-plat (mylar) prior to plat for address placement, street names, and title block.
b. A $10.00 per lot and tract platting fee will be due at the time of the review of the pre-plat, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of December 5th 2023, the fee for all credit/debit cards has changed from the flat 2.95% fee to the following: Over the phone Credit/Debit Card payments will be 2.3% and In-Person Debit Card payments will be 1.5% (in-person only).

The Black Forest Land Use Committee has no objection to this filing since it was part of the original preliminary plan for Flying Horse North. However, we are confused that an old preliminary plan which to us should have been superseded by the new sketch plan is now being resurrected for filing.

The confused combination of an old preliminary plan, a new sketch plan and a new metro district service plan are not normal and contradict each other in several ways.

We contacted the applicant(s) directly and attempted to contact the EPCo Project Manager to seek clarification. Upon conversations with applicant(s) regarding this project and another adjacent project, the applicant(s) are working on revising documentation/plans to comply with EPCo LDC. EPCo maintains Authority and jurisdiction of El Paso County Land Development Code and therefore applicant will likely be seeking clarification and guidance from EPCo on conformance to code requirements.

Academy District 20 is in receipt of File # SF2326 for approval of the Flying Horse North Filing No. 3.

The District is requesting fees in lieu of land dedication per the existing El Paso County Code for all residential units within this development.

The District is able to serve each student who is a resident of District 20.
