1. I have reviewed the draft covenants. Most of the Water Covenants, particularly paragraphs 1-5, are unnecessary and create confusion as to what water rights are being reserved for use in the subdivision, what water rights are being conveyed to lot owners, what the obligations of the lot owners are, and what is just information copied from the water decrees, water resource report, and other documents. I recommend you rework or delete paragraph 1-6. Please see Paragraph C of the Requirements in the County Attorney's Office's Water Supply Review. It contains the obligations and language that must be included in the covenants to comply with County requirements. They should cover most if not all of what you're trying to accomplish with your paragraphs 1-6.
2. Note that Lot 3 is the one limited to 0.38 AF/year and required to comply with the Replacement Plan, not Lot 4.
3. Please provide form deeds for review pursuant to Requirement F of the Water Supply Review.

This plan would require driveway access for lots 1-3 from the unnamed roadway running N/S from Davis Rd.
There are three other existing addresses to the North currently using this roadway (parcel 433000004) that are addressed from Davis Rd. As development continues in this area, continued addressing from Davis Rd could easily cause confusion for emergency services.

It is the recommendation of E911 that this N/S roadway be named, which would require address changes for all existing addresses from Davis Rd that use this roadway.
We would recommend that the developer work with these owners to determine an appropriate name for this access that works for everyone.

It is the recommendation of E911 that this N/S roadway be named, which would require address changes for all existing addresses from Davis Rd that use this roadway.
We would recommend that the developer work with these owners to determine an appropriate name for this access that works for everyone.

Regarding a request for approval of a plat for Murr Subdivision, Enumerations has the following comments:

1. As per the comments from El Paso Teller 911, Enumerations also feels it would be beneficial to name the access road that serves multiple parcels. This would necessitate address changes for the 3 residences on parcel 4333000004, as well as the existing residence on the parcel to be platted. Instructions on how to request an address change can be found on the RBD website. Enumerations would need evidence that the ownership of the residences on parcel 4333000004 are on board with the change.
2. Once a street name is settled on, submit a copy of this development to Enumerations for address assignment.
3. The floodplain statement shows the incorrect FIRM panel. The correct panel is 08041C0780G
4. Prior to recording, Enumerations will review the mylar for addressing, street names, title block and floodplain statement. An Enumerations fee of $10 per lot will be due at the time of review.

The water resources report (as well as the additional report included as Exhibit F) does not provide a clear analysis of water rights vs. potential water usage for the subdivision in order to obtain a finding of sufficiency with regards to quantity and dependability. The Exhibit F report goes back and forth with referencing the proposal as four lots and five lots. Please revise the report to reflect the actual proposal and to include an analysis of the water rights vs. the proposed water usage, as well as to include any augmentation requirements. The available referral documents for the 14090 Davis Road Minor Subdivision site (38.87, -104.565) include a Soil, Geology, and Geologic Hazard Study (Entech Engineering, Inc. Job No. 221987, November 10, 2022). CGS agrees with Entech’s geologic interpretation, identification of geologic hazards and engineering constraints associated with the geology, and their proposed mitigation for these conditions. Provided Entech’s recommendations are strictly adhered to, CGS has no objection to approval. Specifically, as stated by Entech (p.7), “Individual investigations for new building sites and septic systems will be required before construction.” These site-specific investigations, testing, and analysis are required to determine basement feasibility and design foundations, floor systems, subsurface drainage, pavements, and septic systems.
