This will be presented to the Airport Advisory Commission with the below comments on 10/24/2023.

Airport staff recommends no objection with the following conditions:

• Avigation Easement: An avigation easement is requested or provide proof of previous recording (book/page or reception number) for development plat.

• Airport Acknowledgement: Upon accepting residency within Peaceful Ridge, all adult residents and occupants shall be required to sign a notice in which the tenant acknowledges that Peaceful Ridge lies within an Airport Overlay Zone and is located less than 3 miles from Colorado Springs Municipal Airport and may, at times (24 hours per day), experience noise and other activities and operations associated with aircraft and the Airport.

• FAA Form 7460-1: If use of equipment (permanent or temporary) will exceed 150 feet above ground level in height at this site, the applicant is to file an airspace evaluation case with the Federal Aviation Administration (FAA) and provide the results to the Airport before the commencement of construction activities. Service Plan does not provide enough detail to review drainage and transportation cost estimates against the latest FAE that has been submitted. The latest Financial Assurance Estimate (FAE) submitted under PCD File # CDR2215 had a total amount of $8.84M. which included stormwater drainage, wastewater, water, interior roads and offsite improvements. The original cost estimate from the original plat submission in 2006 was $1.73M and it included stormwater drainage, interior roads, wastewater, water service and offsite improvements.

Page #6 of the Service Plan appears to have duplication of infrastructure costs between the three listed categories (Drainage, Street Improvements and Safety Protection). It also includes items that are not applicable to this development such as bridges, tunnels and railroad crossings. Many items listed within "Safety Protection" should be listed in the Street Improvements as the Safety Protection appears to be duplicative in nature or non-applicable. Recommend this category be removed or at least more clearly detailed.
Recommend that a more detailed breakdown of Drainage and Transportation infrastructure improvements cost estimates are provided in Exhibit C.

Fountain Mutual Irrigation Company

The Fountain Mutual Irrigation Co. (FMIC) canal runs along the north side of Fontaine Blvd. and then turns to the north along Marksheffel Road before crossing under Marksheffel Road and heads east into the Lorson Ranch Development project. The crossing of Marksheffel Road is in a 36" diameter RCP pipe and is located approximately halfway up the Cottonwood Meadows Development project prior to heading east into the Lorson Ranch project. The canal then turns to the south and follows the west side of the relocated Jimmy Camp Creek through the Lorson Ranch Development Project.

The FMIC canal does not get close to the proposed the Peaceful Ridge Metropolitan District Amended and Restated Service Plan. FMIC takes no further exception to this proposed Metropolitan District and will have no further comments pertaining to this project.
