The Parks and Community Services Department has reviewed The Estates at Cathedral Pines PUDSP and Final Plat applications and is submitting the following administrative comments on behalf of El Paso County Parks: (1) The applicant has provided open space dedications in excess of 10% consistent with PUD zoning, shown them as tracts or conservation areas, and included the appropriate plat note and land use table on the final plat drawings (2)The applicant has shown on the final plat and dedicated to El Paso County a 25-foot trail easement, north-south along the eastern boundary of Lot 1 and Lot 8 to connect the existing county trail along Winslow Drive; (3) The applicant has shown on the final plat and dedicated to El Paso County a 25-foot trail easement, north-south along the western boundary of Lot 6 and Lot 7 for the Palmer Divide Regional Trail; (4) The applicant has shown on the final plat and dedicated to El Paso County a 25-foot trail easement, east-west along the southern boundary of Lot 1 and Lot 2 for the Palmer Divide Regional Trail; (5) required fees in lieu of land dedication for regional park purposes in the amount of $3,680 will be due at recording of the final plat. 5/1/2024 7:08:43 AM

BFFR has reviewed the fire protection report provided by the applicants PE. The report is well written and appears to demonstrate conformance to the County requirements. Of note, the report states, "The cistern volume was calculated using the County LDC Section 6.3.3d Environmental Standards for Fire Protection and Wildfire Mitigation. The total acreage of the lots encompassing dwelling units is 30.52 acres and was multiplied by the 300 gallons per acre to equal a total of 9,156 gallons.

The number of dwelling units (8) was then multiplied by the 3,000 gallons per unit for a total of 24,000 gallons. Per the County LDC Section 6.3.3d Environmental Standards for Fire Protection and Wildfire Mitigation, the two calculations were combined for a total of 33,156 gallons required for the site. Thus, with the supply from the existing cistern as well as the fire response trucks, there will be a sufficient water supply for the proposed site."

To be certain the county has sufficient information when making their determination, cistern operations are unable to effectively draft all water from a cistern. Therefore, any assumption of having all 33,000 gallons as usable is not accurate but this is not commonly known and the report in our opinion demonstrates conformance and the proximity of the cistern assists greatly with the water supply operations. As the County is the Authority Having Jurisdiction (AHJ) the determination is theirs alone and it appears the PE has demonstrated conformance.

Black Forest Trails Association recommends that the following be considered when evaluating The Estates at Cathedral Pines Final Plat:

This project is in the path of important trail connections for the Palmer Divide Regional Trail and La Foret Regional Trail. For many years El Paso County Community Services trail maps have depicted routes in this location as Proposed Primary Regional Trails.

Trail easements are not shown on the Final Plat. We request that they be added .

1) The east-west Regional Trail corridor from Milam Rd/Black Forest Regional Park, to Winslow Dr intersects with Winslow Dr on its east side. A trail easement is needed to extend the Regional Trail westward from Winslow Dr,+ along the southern boundary of Lots 1 and 2 to the La Foret Trail.

2) A north-south trail easement is needed along the east boundary of Lots 1 and 8 for an off-road trail segment between the Regional Trail which accesses Black Forest Regional Park and the county trail which currently exists between Cathedral Pines and The Estates at Cathedral Pines.

3) A trail easement on the west boundary of Lots 6 and 7 for Retgional Trail connection.

We request that, on the Final Plat, these trails be noted as NON-MOTORIZED, MULTI-USE, INCLUDING EQUESTRIANS on all trails.

a. Enumerations will review the pre-plat (mylar) prior to plat for address placement, street names, and title block.
b. A $10.00 per lot and tract platting fee will be due at the time of the review of the pre-plat, (two addresses per lot and tract). If an address is not needed on a tract then no fee applies. Check should be made out to PIKES PEAK REGIONAL BUILDING DEPARTMENT or PPRBD. Paid directly to the Enumerations Department. As of December 5th 2023, the fee for all credit/debit cards has changed from the flat 2.95% fee to the following: Over the phone Credit/Debit Card payments will be 2.3% and In-Person Debit Card payments will be 1.5% (in-person only).
c. A copy of the final recorded plat is required prior to plan submittal for RESIDENTIAL. A copy of the final recorded plat is required prior to approval in the Enumerations department on any COMMERCIAL plan submittal. Please email the Enumerations staff member that reviewed your project. d. Pre-plat reviews can be reviewed via “pdf” or in-person. The pre-plat will be stamped by Enumerations for accuracy and returned to the applicant and the planner. If any pre-plat changes occur, even if changes do not apply to Enumerations, we still need to re-stamp the pre-plat. The Colorado Geological Survey (CGS) has reviewed the resubmittal (PCD File # SF2234, located at 39.0293, -104.7456). Documents relevant to our review of the resubmittal included Plat Drawings (JR Engineering, Job No. 25260.00, November 17, 2023). Plat note 20 should be updated to reference the Soils and Geology Study performed for this site. Our previous review dated 4/11/2023 noted, “The letter of intent discusses the geologic conditions and states that a requirement for lot-specific subsurface soil investigations before construction will be noted on the Final Plat.” This note still needs to be added to the Plat.

As previously stated, “CGS has no objection to the planned development as shown, provided all RMG’s recommendations are strictly adhered to, specifically that homes and On-site Wastewater Treatment Systems avoid the seasonally wet areas as mapped by RMG, and lot-specific investigations are required as stated in the letter of intent.”

The Colorado State Forest Service recommends that all forested acres be mitigated to reduce the risk of wildfire and that defensible space be created for each dwelling using the standards in the CSFS "Home Ignition Zone Guide" (formerly known as "Quick Guide FIRE 2012-1: Protecting Your Home From Wildfire") located on the Colorado State Forest Service website.

The fire protection report does not demonstrate conformance with the El Paso County Land Development Code or the Engineering Criteria Manual. The County is the AHJ and has maintained a practice requiring a cistern for any developments of 5 lots or more. Our recommendation is applicant demonstrate full compliance and conformance with El Paso County’s adopted Land Development Code (LDC), Engineering Criteria Manual (ECM), adopted International Fire Code (IFC), and all other adopted codes, provisions, or statutes that impact fire safety to include access/egress, water supply, hardening of structures, addressing, fire protection systems, etc. The applicant submit a comprehensive fire protection report from a qualified fire protection engineer that is licensed as a Professional Engineer (PE) by the Colorado State Board of Registration for Professional Engineers to demonstrate conformance to all requirements.
